Andrew and Tristan Tate remain in a Miami detention facility awaiting extradition to the United Kingdom. Their attorney Joe McBride is once again turning to a podcast to press the Trump administration for help.
According to sources, McBride suggested in a podcast that officials he has spoken with are unwilling to intervene because of the fallout from Ghislaine Maxwell’s case.
McBride pointed to Maxwell’s placement in a minimum security federal facility as evidence of a double standard.
He stated, “Meanwhile, Ghislaine Maxwell is in a in a camp somewhere, a federal camp. She’s in the best possible situation she could be in in jail and nobody else has been arrested. Why? Why hasn’t that happened? Big question mark. So the big excuse is we can’t afford another Epstein situation.”
He then objected to any comparison between his clients and Jeffrey Epstein.
McBride noted, “My response to them is don’t you ever in your life put that man’s name in the same sentence with Andrew and Tristan Tate. They are nothing of the sort.”
“And just because you botched that investigation and you botched those arrests and that quest for justice doesn’t mean that you should sacrifice two American patriots who’ve been on the right side of everything because you’re too much of a coward to do the right thing here.”
McBride also described conditions inside the facility, claiming the brothers share a cell “5×7 or 5×8 at maximum,” sleep on beds that “aren’t long enough for them,” and lack a pillow. Prosecutors reportedly countered that the men are provided a pillow built into their mattress rather than a separate one, and are not entitled to additional amenities like nail clippers or blankets.
A medical expert brought on the same podcast argued the brothers’ nutrition has been poor. The expert stated, “The nutrition is not that good.”
McBride followed it up by saying, “Unfortunately, no, it’s very, very bad. They’ve only recently had access to an amount of calories that would be sufficient for a normal person, never mind somebody their stature.”
However, commissary records reportedly show the brothers ordering cookies, ice cream and chips. The Department of Justice has also disputed Tristan Tate’s claim that he lost 13 pounds (5.9 kg) behind bars, reportedly finding he had gained weight after being placed on a scale.
